Legal Scholars: Thumbs Down on Patent and Copyright

There has long been skepticism about state-granted ?intellectual? monopoly privileges among economists, and even this is growing in recent decades. See, e.g., my posts?The Overwhelming Empirical Case?Against?Patent and Copyright,?The Four Historical Phases of IP Abolitionism, and?The Origins of Libertarian IP Abolitionism. As a sampler (more detail in the first link above):

Fritz Machlup, 1958:

No economist, on the basis of present knowledge, could possibly state with certainty that the patent system, as it now operates, confers a net benefit or a net loss upon society. The best he can do is to state assumptions and make guesses about the extent to which reality corresponds to these assumptions. ? If we did not have a patent system, it would be irresponsible, on the basis of our present knowledge of its economic consequences, to recommend instituting one.

Fran?ois L?v?que and Yann M?ni?re (Ecole des mines de Paris, 2004):

The abolition or preservation of intellectual property protection is ? not just a purely theoretical question. To decide on it from an economic viewpoint, we must be able to assess all the consequences of protection and determine whether the total favorable effects for society outweigh the total negative effects. Unfortunately, this exercise [an economic analysis of the cost and benefits of intellectual property] is no more within our reach today than it was in Machlup?s day [1950s].

Boston University Law School Professors (and economists) Michael Meurer and Jim Bessen concluded (2008) that on average, the patent system discourages innovation. As they write: ?it seems unlikely that patents today are an effective policy instrument to encourage innovation overall? (p. 216). To the contrary, it seems clear that nowadays ?patents place a drag on innovation? (p. 146). In short, ?the patent system fails on its own terms? (p. 145).

And in a recent draft paper (2012), economists Michele Boldrin and David Levine state:

The case against patents can be summarized briefly: there is no empirical evidence that they serve to increase innovation and productivity, unless the latter is identified with the number of patents awarded?which, as evidence shows, has no correlation with measured productivity. This is at the root of the ?patent puzzle?: in spite of the [enormous] increase in the number of patents and in the strength of their legal protection we have neither seen a dramatic acceleration in the rate of technological progress nor a major increase in the levels of R&D expenditurein addition to the discussion in this paper, see Lerner [2009] and literature therein. As we shall see, there is strong evidence, instead, that patents have many negative consequences.

What about lawyers and legal scholars? Well, among practicing lawyers, some of whom pose as scholars, the most vociferous ones tend to be those who know a bit about patent or IP law. Those tend to be practitioners who are naturally biased toward supporting this system; it pays the bills. So it?s no surprise most IP practitioners come up with arguments in favor of patent or copyright, when pressed; but they argue like lawyers, which is to say: like advocates pressing a case, instead of scholars or scientists trying to find the truth; and like unprincipled, ignoramus utilitarians. ?So of course we have a slew of IP apologists and shills?patent lawyers like?Dale Halling, ?Gene Quinn,?Lawrence Ebert, and John Harris. They never have any real arguments; they might as well say, ?we make money from this system and like it!? Which is hard to disagree with, but is ? not an argument for maintaining the IP system. Still, despite the pressure on IP specialists to toe the line, most never try to justify it, many realize that arguments in favor of it are flawed, and a brave few actually come out openly in opposition.

But there seems to be a growing tide of law professors and other legal scholars who are deeply suspicious of patent and copyright and who favor drastic scaling back of these laws if not outright abolition. Such as:

Unfortunately, most of these scholars are mired in an empiricist-positivist-monist-utilitarian mindset. But they manage to lean in the right direction anyway. Most impressive.

Interestingly, the two notable exceptions to this trend that come to mind and who are pro-IP, are libertarian law professor Richard Epstein and Objectivist Adam Mossoff. But this, too, shall pass.

Metabolic factors increase risk of prostate cancer death in men

A new study shows that a man?s risk of dying from prostate cancer is higher if he suffers from high blood pressure, has a high BMI, and has high blood sugar, a condition commonly referred to as the metabolic syndrome.

Medical News Today reports the study, which appeared in the September issue of BMC Medicine, did note that obesity did not increase the risk of developing prostate cancer.

As a results of the study, the authors suggest that public health recommendations regarding lifestyle and diet, which are currently categorized to help prevent Type 2 diabetes and heart disease, be changed to include lowering the risk of prostate cancer death.

As Science Daily reports: ?During an average follow-up time of 12 years, 6,673 men were diagnosed with prostate cancer and 961 died from the disease. Men in the highest categories of body mass index and blood pressure had a 36 percent and 62 percent increased risk of dying from prostate cancer, respectively.?

Though the increased metabolic factors did not lead to more cases of prostate cancer, the study appeared to find a link suggesting that, if those in the high metabolic syndrome range did develop prostate cancer, they were more likely to die from the disease.

?These observations suggest that cardiovascular risk factors such as overweight and hypertension are involved in stimulating the progression of prostate cancer,? Dr. P?r Stattin said.

Prostate cancer, according to 2011 World Health Organization statistics, is the second most common cancer among males and the sixth leading cause of cancer deaths globally among men. The reach of the disease varies around the globe however. The United States has a higher percentage of prostate cancer diagnosis than anywhere else, while it is less common in South and East Asia.

NHL gave clubs 2-day window to talk to players

(AP) ? While negotiators for the NHL and union kept conversations to a minimum, club officials had a brief window last week to discuss the league's latest proposal with its locked-out players.

So far, those discussions haven't produced any breakthrough, but they have inflamed an already unsettled atmosphere. The union hierarchy wasn't informed about the window then, and isn't happy about it, either.

"Most owners are not allowed to attend bargaining meetings," players' association special counsel Steve Fehr said. "No owners are allowed to speak to the media about the bargaining. It is interesting that they are secretly unleashed to talk to the players about the meetings the players can attend, but the owners cannot."

The NHL said Tuesday that team officials may have temporary contact with players, although there are parameters regarding what can be discussed.

"From our perspective, this is a nonissue and a nonstory," NHL deputy commissioner Bill Daly said Tuesday in an email to The Associated Press. "There is nothing ? legally or otherwise ? that precludes club personnel from communicating with their players."

But, more important, is the fact that NHL officials aren't talking to union leaders, and there are still no plans for negotiations to continue after breaking off last week. The hope of reaching a quick deal and getting a full season under way Nov. 2 is quickly evaporating.

If a new collective bargaining agreement isn't reached by Thursday, NHL Commissioner Gary Bettman says a full season won't be able to be played. As of now, the league has called off all games through Nov. 1. Without a deal this week, those games are in danger of being called off for good.

Last week, the NHL's most recent contract offer ? featuring a 50-50 split of hockey-related revenue ? was presented to the union and then publicly released in full. The union returned to the bargaining table last Thursday with three counterproposals, that would also get to an even split of hockey revenue, but each was quickly rejected by the league.

There is a major divide between the sides over how to deal with existing player contracts. The union wants to ensure that those are all paid in full without affecting future player contracts.

No negotiations have taken place since last week, but the sides held two conference calls over the weekend to address questions the union had regarding the NHL offer.

After the NHL released it on Wednesday, club officials were given until Friday to speak to players and answer questions they might have about the proposal.

In an internal league memo obtained by The Canadian Press, the NHL stated that those discussions must be limited to the contents of the proposal on the table. It also provided examples of questions that shouldn't be asked of players and noted that straying from the rules could "cause serious legal problems."

"You may not ask (a player) what he or others have in mind," the memo stated. "If he volunteers what he has in mind you should not respond positively or negatively or ask any questions but instead refer him to the NHLPA.

"Likewise, you may not suggest hypothetical proposals that the league might make in the future or that the league might entertain from the union."

This was the first time club officials were permitted by the NHL to talk to players since the lockout took effect Sept. 16.

First I want to say welcome to my little corner of the web here at E-junkie. As an E-junkie customer for a few years now, I?m thrilled to be a guest poster for them. In my posts here, you?ll find first-hand info on everything from self-publishing to SEO. Now, to today?s topic . . .

In today?s post, I?m going to provide some insight on how to write ebooks ? ebooks that sell. In 2011, I chronicled my quest to publish 50 ebooks in 12 months ? so I get a lot of questions about self-publishing.

Following, in my opinion, is the most important thing you need to know about how to write ebooks that sell.

Is There a Big Enough Audience for Your Ebook?

Before you write a word, you should do some research to determine if there?s a big enough audience for you to make enough sales for it to be worth your time. While this may seem obvious, you?d be amazed at how many writers get an idea and run with it before doing this upfront work.

But like in any business, (and that?s what ebook writing / self-publishing is ? a business), if there aren?t enough customers who will buy your product/service, you?re not going to make any money.

?So,? you may be thinking, ?how do I go about finding out if there?s a large enough audience for my ebook??

In a word ? SEO ?. . . aka search engine optimization.

What Is SEO and Why Every Ebook Author Needs to Know

SEO is all about how search engines work. It examines factors like what people search for when they go online and the actual words and phrases they type in to find stuff. FYI, these are known as keywords/keyword phrases. Website analysts (and website owners) use this info to do certain things to their website to make it pop up higher in search results so that web surfers land on their site.

If you don?t know what search engine optimization is, it?s critical that you learn at least the basics of it because self-publishing is an online business. And, you can?t talk about marketing an online business these days without talking about SEO.

Here?s a Quick Rundown of How to Use SEO to Find Out if Your Ebook Will Sell

I?m going to use an example from one of my niches ? SEO writing.?I've?written several ebooks on this topic. Here?s a ?quick-and-dirty? rundown of what you need to do before writing a word.

1) Do keyword research: Go to Google?s Keyword AdWord Tool. I typed in the keyword phrase ?SEO writing? (without quotation marks). As of this writing, that particular keyword phrase is searched for over 40,000 times globally (40,500 to be exact).

So I surmise that yes, there?s a big enough audience for an ebook on this topic. Now the next challenge is can I get my ebook / info about my ebook on the first three pages of Google. Why is this important? Read on.

2) Can you get on one of the first three pages of Google: Studies have proven that most web surfers don?t look past the first three pages of search results. Proof?

Seventy-four percent of consumers said they usually abandon search results if they can?t find desired information within the first three pages of SERPs, according to a survey from AYTM Market Research. . . . [And] Just 15 percent of respondents said they scan five pages of results, with 61 saying if they don?t find what they?re looking for they try a new keyword search. [Source: Brafton, Incorporated]
Once you write an ebook, the key to getting it on the first three pages of Google is to assess who?s already there ? and to see if you can bypass them in search results. One of the easy metrics I look at is page rank (PR). If a website has a PR rank of 4 or higher, then I know that it?s going to be pretty hard to outrank them (eg, get on one of the first three pages).

But, if there are three to five sites on the first page of Google that have page ranks of 3 or lower, then I know that I have a pretty good shot. Note: I always aim for the first page. Hence, I assess who?s on the first page of Google. It doesn?t always work ? at least not right away. But if there are ?weak-ranking sites/blogs? (ie, those with a PR of 3 or lower) and I keep at it, usually within 3-6 months I eventually land on the coveted first page.

Here?s a link that lets you quickly check the page rank of any site.

3. Start writing: In case you?re wondering what I do to get on the first page of Google, it?s article marketing, ie, writing SEO articles (and blog posts and press releases). I then distribute them far and wide on the web to, for example, article directories and free press release sites. I also write and distribute weekly newsletters, in addition to blogging consistently.

This works. Proof? Search results change all the time but as of this writing, if you go to Google and type in ?SEO writing,? you?ll find info written by me in two spots on the first page (position #1 and #6).

How to Write Ebooks that Sell: Conclusion

I tell everyone who asks me about self-publishing that writing an ebook is the easy part. Ebook marketing is where the real work comes in. It?s not hard; it?s just that there?s a lot to learn ? and it?s an ongoing process.

But I?m living proof that if you want to write and publish ebooks that sell ? it?s totally possible. In 2010 ? for the first time ever ? my ebook earnings surpassed what I made as a freelance writer (and I?ve been doing that since 1993).

Ancestry.com is being sold to European firm Permira for a whopping $1.6 billion. Not bad for a site that bases its entire existence on tracking a person?s family tree.

According to reports, Ancestry.com agreed to the 9.7 percent premium sales price on Monday. Ancestry.com first explored a sale in June; since that time, shares have skyrocked by 41 percent at the genealogy website.

Since going public in 2009, shares at Ancestry.com have more than doubled, attracting attention from various private equity firms.

Ancestry.com is a huge hoarder of data with more than 2 million paying subscribers, 10 billion records, and almost 40 million family trees.

Ancestry also owns websites MyFamily.com, ProGenealogists, and Rootsweb.com, genealogy software Family Tree Maker, and Footnote.com. The latter platform holds billions of image that contain various historical records.

Ancestry.com is a global company that operates websites throughout parts of Europe and in Australia, China, and Canada.

There are various family ancestry sites, but Ancestory.com has become a mainstream entity, going so far as to partner with NBC for the reality TV show Who Do You Think You Are??which helped celebrities trace their family genealogies.

Ancestry.com is also no stranger to controversy. The site came under fire last year when the social security numbers of recently deceased people were leaked through the company?s Social Security Master File.

How Permira will leverage Ancestry.com to earn back its $1.6 billion buy price is not yet known. With the ability to reach a large unique visitor base, it?s likely that much of Ancestry.com will continue with business as usual.

WADI DINAR, Libya (AP) ? Pro-government militias battled fighters in a former stronghold of the late Libyan dictator Moammar Gadhafi on Sunday, the fifth straight day of clashes that have killed at least 30 people.

The fighting in Bani Walid, some 140 kilometers (90 miles) southeast of Tripoli, has overlapped with the anniversary of Gadhafi's capture and killing on Oct. 20, 2011. A year since his death brought an end to Libya's civil war, Bani Walid is the most significant city in the country to still resist the nation's new authorities.

A resident said Sunday by telephone that pro-government militias and fighters in the city were clashing on its outskirts. The resident, who spoke on condition of anonymity for fear of reprisals, said there were reports of new casualties, but that the fighting was less intense than a day earlier.

In Tripoli, some two hundred protesters demonstrated in front of the parliament building to urge the end of the fighting, which they say is harming only civilians. The demonstration was dispersed by a massive show of force when army units pulled up and opened fire above the heads of the crowd with heavy weaponry.

Government forces near Bani Walid said there were no civilians in the conflict area, and they had helped evacuate hundreds of residents a day earlier.

The official LANA news agency said at least 22 pro-government militiamen were killed during clashes Saturday. Pro-government militiamen said most of the casualties came during an ambush by fighters in the besieged city.

The violence Saturday coincided with conflicting reports about whether security forces had arrested Gadhafi's former spokesman, Moussa Ibrahim, in Bani Walid.

The government said its forces had apprehended Ibrahim, but never produced evidence to support its statement. Then an audio recording purportedly by Ibrahim surfaced on the Internet denying that he had been arrested or that he was even in Libya.

The reports of Ibrahim's alleged arrested sparked brief celebrations in the Libyan capital. But in a reflection of the persistent lack of confidence in the new authorities, Libyans quickly began to demand that the government produce evidence ? photographs or video ? to back up their claims.

Government spokesmen could not be reached for further comment about Ibrahim.

Violence has flared periodically over the last year in Bani Walid. This round of fighting began when the pro-government Libya Shield militia besieged the town, blaming residents for the death of a well-known anti-Gadhafi rebel. Negotiations to hand over the suspects in the killing had failed.

Pro-government fighters on the road outside of Bani Walid were transporting fleeing civilians and foreign workers from the fighting. Some of the fleeing workers said others were locked up in the city because of the heavy shelling.

In the Wadi Dinar area, about 50 kilometers (30 miles) outside of Bani Walid, one pro-government fighter said civilians in the city are making it harder for his troops to go after fighters loyal to Gadhafi.

"We are doing two jobs. We are rescuing foreign workers, Egyptians and Africans, and putting them on vehicles out of the fighting area, and we are combing the area for armed gunmen," he said speaking on condition of anonymity because he was not authorized to speak to reporters.

Another fighter, Nidal, from Libya Shield, said the fighting over Bani Walid was focused on two fronts but that his opponents are well armed. He was speaking as clashes continued at the Wadi Dinar gate into the city, saying his force and the Bani Walid fighters were exchanging fire from two hilltops.

"This is going to take more than one day. There is a distance between us," he said.

In Tripoli, the situation in the late afternoon was tense around the parliament with dozens of protesters at the doors of the building itself while outside a few hundred more called for the end to the siege.

Militiamen acting as police arrived to contain the crowd but many were from the Souq al-Jumaa neighborhood, which earlier in the year lost several fighters in Bani Walid. The confrontation resulted in angry exchanges.

The men fired in the air several times to disperse the crowd, who responded with defiance, waving Libyan revolutionary flags and bearing their chests in front of the militiamen. Women made up around half of the crowd.

"In Bani Walid no one supports Gadhafi," said a veiled woman who identified herself only as Um Mohammed, or mother of Mohammed. "We support this government."

Um Mohammed said her children and husband were in Bani Walid.

"We need protection," she said, expressing her fears that the pro-government militias would take their revenge on the city and destroy it like they have others.

The militiamen were unsympathetic and at times prevented the protesters from talking to journalists and started hauling people out of the crowd, detaining them and beating them near their trucks.

"These people here say they want their freedom, but we gave them a lot of chances to change their mind," said one militiaman. "A lot of Gadhafi people are hiding there and people from Bani Walid have killed a lot of people form Souq al-Jumaa."

The standoff ended when 12 army trucks pulled up filled with men wearing new camouflage uniforms who fired into the air with anti-aircraft guns, sending everyone to the ground.

The trucks then drove into the parliament compound and used similar methods to disperse the people inside. Journalists were also stopped from photographing.

What's New: Nissan is pushing fuel economy as the most important attribute in the seven-passenger-crossover segment, with admirable results. The new Pathfinder bests the outgoing version's mpg numbers by 30 percent, putting it well ahead of its competition (though it's still possible the AWD seven-passenger Hyundai Santa Fe could come close). Nissan's engineers achieved this by losing the body-on-frame setup of the old rig and cutting 500 pounds in the process. At the same time Nissan also managed to greatly increase interior volume; there's more headroom and legroom throughout, and far more cargo volume too.

The old five-speed automatic is history, replaced by a CVT with an equivalent gear range of a seven-speed auto, minus any hunting for power. Displacement drops from a 4.0-liter V-6 to a 3.5. That results in a loss of six horses. But, more noticeably, there are 48 fewer lb-ft of torque. Still, acceleration is plenty strong, and the biggest change in driving feel is a bit of torque steer because this crossover defaults to its fuel-sipping FWD arrangement unless there's wheel slip. Minus that blemish, the Pathfinders we drove proved smooth and comfortable over long miles of broken northern California asphalt?something we wouldn't have said about the outgoing model.

Tech Tidbit: Parents had a major problem with the old Pathfinder: They couldn't access the third-row seats without removing the child car seats in the second row?a cumbersome, annoying process. The 2013 Pathfinder has what Nissan calls EZ Flex seats, specially designed to slide forward while the child seat remains in place and allow third-row access without monkeying with the mechanics.

Driving Character: This Pathfinder is not like any that's come before it because of its distinctly carlike ride. That comes courtesy of not only a fully independent suspension like that of the new Ford Explorer, but of a center of gravity that has dropped nearly 3 inches. This new Nissan actually rides lower than a Subaru Outback, and barely an inch higher than an Impreza. As a result, the dreaded "head-toss" sensation that turn your children green in the third row when you're battling a country road on the way to the park pretty much evaporates.

We tested the AWD edition of the Pathfinder on an off-road course with some very steep ascents that required locking the transmission into a dedicated 50/50 split of power to both front and rear axles. The vehicle had no trouble, and even the CVT, which you might think would experience some sensation of slip, was perfectly adequate for the task.

But the Pathfinder is more at home on the asphalt, and the watchword here is "smooth." The new crossover has excellent on-center feel to the steering and just enough agility to make the Pathfinder reasonably sporty, minus some of the semistiff ride of the Ford or the occasionally brittle ride of the Honda Pilot. You could say it's closest to the Toyota Highlander because it's comfortable, but Nissan infuses just enough character to make it a little more entertaining than that rig. If you're bummed about the Pathfinder getting soft, Nissan says it will keep the Xterra "real"?and that almost nobody buys a seven-passenger crossover to drive off-road anyway.

Favorite Detail: There's a small cavity in the hatch area that's perfect for holding groceries. It's normally covered by a carpeted panel, the better to hide valuables. In the past Nissan didn't hinge this door in the floor with any sort of "stop" to hold it upright, meaning fragile items such as eggs or veggies in your grocery bags would get crushed by the lid. Nissan wisely updated the system, which now has a friction hinge that stops the lid in the upright position and holds it there even if you drive around in stop-and-go traffic.

Driver's Grievance: It's great that Nissan added a bullet-shaped third window to the Pathfinder. It brings just a little more light into the dark third row. The downside is that this row also features very large headrests that block a driver's rearward view. Sure, you can get Nissan's "around-view" camera system, but that's really only valid for parking lot duty. If you're driving in town, the over-large headrests are a hinderance to safer lane changes. You can get rid of them easily, but remembering to do this is another matter.

The Bottom Line: We agree with Nissan that customers really aren't buying vehicles like the Pathfinder for climbing 20-degree slopes of mud, so it's completely logical for them to make a vehicle that can handle some off-roading but really is a fuel-efficient, seven-passenger family wagon that happens to look like a crossover. Cross-shopping for the most similar car to the Pathfinder would probably bring you not to another traditional crossover, but to the perennially excellent Acura MDX, a vehicle with zero off-road pretensions but with all the creature comforts of a luxury sedan.

The Pathfinder is roomy, smooth as silk on the interstate, and church-quiet, as well as lounge-comfortable. And it's confidence-inspiring for the breed: At one point during our test, a young girl darted in front of us at a crosswalk and we were forced to stand on the brakes. The Pathfinder stopped on a dime, no harm done. Like we said: smooth, safe, and pretty darn smart too.

Lawyers, CEOs boosted Obama's Sept. donations

(AP) ? Attorneys, business owners and retirees were among those who helped President Barack Obama maintain slim fundraising supremacy over Republican challenger Mitt Romney last month, with the president raising $181 million as he entered the last full month in the fight to keep his job.

An Associated Press review of newly released financial reports found at least $11 million from lawyers and at least $3 million from investors and bankers, some of whom cooled to the president earlier in this election campaign when critics say he cracked down on Wall Street and pushed for consumer-protection reforms. About $22 million more came from retired Americans, an important bloc of voters likely more tuned in to health care reform and changes in retirement benefits.

Their contributions, among hundreds of thousands, went hand-in-hand with record donations to an outside political group helping Obama win a second term. Still, the president began October with less available money to spend than Romney, as Obama's campaign, the Democratic Party and related groups reported $149.8 million cash on hand. That's compared with $183.1 million in the bank among Romney's campaign, the GOP and his joint-fundraising apparatus.

All told, a swath of small-dollar contributions helped Obama and the Democratic Party best Romney and the GOP by more than $10 million last month after being repeatedly walloped in the money race earlier this year. The president's fundraising haul topped the more than $114 million he and the Democrats raised during the month of August, and the cash Obama pulled in last month was slightly less than his record-breaking $190 million from September 2008.

Financial support to Obama and Romney are putting the presidential election on track to cost nearly $2 billion, thanks to mountains of cash earmarked to both campaigns and independent "super" political committees working on their behalf. Wealthy Americans are increasingly picking up the tab this year, at times giving millions of dollars apiece to super PACs that have buoyed costly advertising.

September's reports show major financial support going to both Republican and Democratic super PACs, with the pro-Romney Restore Our Future PAC reporting it collected $14.8 million in September, the group's second-most lucrative month. Late Saturday, American Crossroads, the major super PAC headed by GOP strategist Karl Rove, reported $11.6 million for September, the highest single-month total for the group.

Rove's top donors in September included Texas billionaire Harold Simmons, who gave $2.5 million and Oklahoma coal baron Joseph Craft III, who gave $1 million. Another $1.32 million was donated by the Armstrong Company, a Pennsylvania conglomerate which provided the donation as "in-kind cable access, and $1 million from Jay Bergman, an Illinois oilman.

Meanwhile, Priorities USA Action, the pre-eminent Obama-supportive super PAC, said it raised a record $15.3 million.

"People who support the president know that we've come too far to go back now," Priorities senior strategist Bill Burton said. "We're ahead a little bit now, but it is time to close the deal."

Both campaigns and super PACs have made an all-out push for contributions as Election Day quickly approaches. The contributions are funding a record-breaking campaign operation for both candidates, which translates to paying a legion of campaign staff and hundreds of millions of dollars' worth of television ads.

So when it came to contributions directly to Obama's campaign, business owners and some Wall Street types helped pick up the tab, even if they didn't make up a majority of total contributions. Obama's donors in September included more than 4,000 CEOs, records show, and his campaign continued to tally millions pouring in from key battleground states.

Yet Obama hardly has a lock on winning the financial fight.

Republican super PACs have helped to match or exceed Obama's TV ad spending in dozens of media markets in battleground states. Ad spending data obtained by the AP from April through early October found pro-Romney spending has exceeded pro-Obama ad spending by at least $65 million across the nine states expected to decide the election: Colorado, Florida, Nevada, New Hampshire, North Carolina, Ohio, Virginia, Iowa and Wisconsin.

Obama broke presidential fundraising records four years ago, but has found himself financially outgunned for much of the summer, thanks in part to super PACs supporting Romney. Meanwhile, an AP review of campaign data this fall found Obama out-raising Romney in most of the 11 states that at one point were pivotal to win the election.

Reports detailing revenues and expenses for the first half of October are due to the Federal Election Commission by Oct. 25. Those will provide the public with the last financial snapshot before the Nov. 6 election.
